DOLE: Workers reporting on election day get additional 30% pay

The Department of Labor and Employment (DOLE) reminded private sector businesses on Monday of pay restrictions for workers reporting for duty on Election Day, May 9.

After President Rodrigo Duterte issued Proclamation No. 1357, establishing the May 9, 2022, national and local elections as a special non-working holiday, the DOLE declared private-sector employees would earn an additional 30% in salary for work performed on Election Day.

“We highly encourage our workers who are registered voters to exercise their rights to suffrage, and if they report to work on May 9 after casting their votes, they must receive an additional 30% in their daily pay,” said Labor Secretary Silvestre Bello III.

The wage rules for Special (Non-Working) Holidays are outlined in Chapter III, Article 94 of the Labor Code, which states that “if employees did not work, the “no work, no pay” principle should apply, unless there is a company policy, practice, or collective bargaining agreement (CBA) granting payment on a special day.”

On the first eight hours of work during the special day, they will be paid an additional 30% of their basic wage, calculated as (basic wage x 130 percent) + COLA.

They will be paid an additional 30% of their hourly rate on the day for work done for more than eight hours or overtime work, calculated as hourly rate of the basic wage x 130 percent x number of hours worked.

Employees who work on a special day that also happens to be their day off are entitled to an additional 50% of their basic wage for the first eight hours of work, calculated as (basic wage x 150 percent) + COLA.

They will be paid an additional 30% of their hourly rate for overtime labor on a special day that also falls on their rest day, calculated as hourly rate of the basic wage x 150 percent x 130 percent x number of hours worked.

Bello further asked workers to report underpayment and non-payment of proper wages to the DOLE Hotline 1349 or the nearest DOLE office in their area if they are having problems.
