Complaints against Christine Dacera’s colleagues dismissed

The City Prosecutor of Makati dismissed the complaints of drug violation, obstruction of justice, perjury, and reckless imprudence resulting in homicide complaints against the colleagues of the late Christine Dacera.

In a statement Monday, the prosecutor said it dismissed the complaints based on a decision made on January 31, connected to Dacera’s death at a hotel in Makati during a New Year’s party in 2021.

“The Office of the City Prosecutor of Makati City, in its Resolution dated 31 January 2022, resolved to dismiss the consolidated complaints– which are the offshoot of the Christine Dacera case,” the resolution said.

The prosecutor’s analysis allegedly showed no evidence against Mark Anthony Rosales, who was accused of illegal drugs, and there is also no evidence of reckless imprudence resulting in homicide filed against John Pascual Dela Serna, Jezreel Rapinan, Alain Chen, and Louis De Lima.

The perjury complaint against Galido, Dela Serna, and Darwin Joseph D. Macalla was also dismissed.

Earlier, the defendants were accused of allegedly using party drugs and raping Dacera, who was found unconscious in the bathroom and was later declared dead.

Complaints against Christine Dacera’s colleagues dismissed

Rosales, Galido, Dela Serna, Macalla, Rapinan, Gregorio Angelo Rafael De Guzma, Alain D. Chen, Reymar Englis, and Atty. Neptali G. Maroto are also acquitted in the complaint of obstruction of justice because “they were simply protecting their rights within the bounds of the law,” according to the resolution.

Even the alleged attempt to provide illegal drugs against Rosales and Galido was dismissed because the said drug was not shown and was not submitted by the prosecution as evidence.

The falsification complaint against Dr. Michael Nick W Sarmiento was also dismissed, as were counter complaints filed by Dacera’s mother Sharon, friends and relatives, and investigators Police Corporal Louie Lopez and Police Staff Sergeant Jun Alimurong.

In April 2021, the Makati City Prosecutor’s Office dismissed the rape with homicide complaint against 11 suspects in the  of flight attendant Christine Dacera.

In the resolution issued by Makati City Prosecutor Joan Bolina-Santillan, it is said that the complaint was dismissed due to the lack of probable cause, especially since it was not proven that the respondents committed a crime.
